LTD Financial Services Limited Partnership is on the receiving end of a proposed class action lawsuit that claims it sent a New York man a collection letter that violated the Fair Debt Collection Practices Act.
LTD Financial Services Limited Partnership is on the receiving end of a proposed class action lawsuit filed back in September that claims it sent a New York man a collection letter that violated the Fair Debt Collection Practices Act (FDCPA). The letter allegedly listed the plaintiff’s “balance,” but failed to indicate whether the amount would increase in the future due to interest, late fees, or other charges.
Furthermore, the plaintiff claims the letter noted his “total Amount of non-interest charges or fees accrued since charge-off” as “$0.00,” implying that additional charges may be added in the future, according to the complaint.
As a result, the suit argues, the defendant failed to clearly and accurately state the amount of the man’s alleged debt as required under the FDCPA.
