Stern v. GC Services Limited Partnership
Filed: January 31, 2017 ◆§ 1:17-cv-00564
Houston, Texas-based debt collection outfit GC Services Limited Partnership is on the receiving end of a proposed class action.
Houston, Texas-based debt collection outfit GC Services Limited Partnership is on the receiving end of a proposed class action that takes aim at its allegedly illegal debt collection practices. Citing violations of the Fair Debt Collection Practices Act (FDCPA), the lawsuit out of New York federal court alleges the defendant attempted to contact the plaintiff by phone on numerous occasions and left numerous messages. The plaintiff claims that the defendant never, at any point, identified itself as a debt collector calling about the collection of a debt, as required by the FDCPA.
“At all times relevant to this action, GC Services Limited Partnership willfully, deliberately, and intentionally chose not to provide meaningful identification of itself in the messages it left for consumers, such as the said messages, by accurately stating the nature and/or purposed of the call.”
