National security firm SOS Security is the defendant in a class action lawsuit that claims the company breached the Fair Credit Reporting Act (FCRA) by acquiring background reports for employment purposes without first making proper disclosures to job applicants in a stand-alone document. This stand-alone document, the lawsuit notes, must be issued by potential employers to let job applicants know a consumer report—from which information is used to conduct a background check—will be obtained as a condition of their possible employment.
The plaintiff also claims SOS Security unlawfully inserted liability release provisions into employment forms instead of presenting them to the applicant in a stand-alone document.
The proposed class covers SOS Security employees and job applicants in the U.S. who were the subject of a consumer report within the last five years.
