Florida debt collection agency Diversified Consultants, Inc. has been hit with a class action lawsuit alleging violations of the Fair Debt Collection Practices Act.
Florida debt collection agency Diversified Consultants, Inc. has been hit with a class action lawsuit alleging violations of the Fair Debt Collection Practices Act (FDCPA). According to the suit, the defendant illegally and intentionally procured debt reports on consumers whose debts had been discharged in bankruptcy. The plaintiffs allege the defendants had “no permissible purpose for accessing such reports.”
The plaintiff says he filed for Chapter 7 bankruptcy relief in 2014, the petition for which contained a list of debts that included the defendants as a creditor. The plaintiff was granted a discharge of his debts at the end of 2014, yet the defendant still attempted to recoup debts that were no longer legally collectible, the suit says.
