FBCS, Inc. and LVNV Funding, LLC are staring down a lawsuit that alleges the companies failed to provide a New Jersey consumer with proper instructions on how to effectively dispute his debt.
The suit, which seeks class action status, focuses on a December 2017 letter sent to the plaintiff regarding an obligation originally incurred on a T-Mobile account. According to the case, the notice did not convey that a dispute must be submitted in writing to obtain verification of the debt. The case argues that the plaintiff effectively waived his rights as he was not adequately informed of his debt dispute options.
