Debt collection agency FBCS, Inc. is the defendant in a class action lawsuit filed over the company’s alleged violations of the Fair Debt Collection Practices Act (FDCPA). Filed in New York, the complaint claims the defendant failed to identify itself as a debt collector and state that it was calling about recovering a debt—both violations of the FDCPA—in any of the numerous phone messages it reportedly left the plaintiff. Failure of a debt collector to properly identify itself as such and state that its calling about recovering a debt, the lawsuit argues, could be viewed as a deceptive tactic used to possibly catch the unsophisticated consumer off guard, which the FDCPA aims to prevent.
