Bronx, New York supermarket operating company Albert Cost Cutters Corp., which does business as Fat Albert, is on the receiving end of a wage and hour class action.
Bronx, New York supermarket operating company Albert Cost Cutters Corp., which does business as Fat Albert, is on the receiving end of a proposed class action that alleges it violated state and federal labor laws by failing to pay current and former employees proper minimum and overtime wages. The plaintiff, who works as a security guard for the defendant, claims he puts in between 40 and 52 hours per week while being paid “approximately no wages for approximately between one and one and one-half hours per week,” the lawsuit claims. As a result, the plaintiff alleges his hourly pay rate has dropped below the federal minimum.
Additionally, the plaintiff claims he receives his wages via paycheck for days worked during the week, yet receives cash for hours worked on Sundays. Lastly, the case notes the plaintiff is allegedly owed unpaid spread-of-hours wages for days in which he worked shifts lasting longer than 10 hours.
