A California man has filed suit against Fare Depot LLC for allegedly failing to inform consumers that their telephone calls with the company were being recorded.
A California man has filed suit against Fare Depot LLC for allegedly failing to inform consumers that their telephone calls with the company were being recorded. The plaintiff says he called the defendant in June 2017 and was never informed by its representative that his call would be recorded. He allegedly discovered later that Fare Depot records all incoming calls. According to the suit, “[the plaintiff] did not give either express or implied consent to the recording.”
After the plaintiff’s counsel sent the defendant a letter regarding the recorded calls, the lawsuit says, the company allegedly changed its prerecorded message to include the following: “This call is being recorded. If you do not wish to be recorded please disconnect at this time.”
