Far Away Springs Alleges Four Defendants Pass Off Raw Water as Spring Water

An individual who does business under the trade name Far Away Springs has filed a proposed class action lawsuit in which he claims four defendants—Niagara Bottling, LLC; Ice River Springs Water Co. Inc.; Crossroads Beverage Group; and one individual who does business as Pine Valley Farms Springs—advertise and sell bottled “raw” water they deceptively pass off as being derived from a natural spring.
The complaint’s most prominent allegation is that the water extracted by Pine Valley Farms Springs at its New Ringgold, Pennsylvania facility does not satisfy the FDA’s definition of “spring water.” To back this up, the lawsuit claims Pine Valley Farms is not recognized by Pennsylvania’s Department of Environmental Protection (DEP) as a permitted spring water site, and is instead recognized by the agency only as a “well water” site.
“All three bottling defendants source raw water from defendant [Pine Valley Farms Springs],” the lawsuit explains. “Bottling defendants then bottle, market, and sell this water as ‘spring water,’ despite the fact that Pine Valley Farms Springs’ water is not properly classified by DEP or otherwise as ‘spring water.’”
