Express Oil Change, L.L.C. is on the receiving end of a proposed class action that alleges the company violated federal law by sending text message advertisements to consumers’ cell phones without first obtaining their consent.
Express Oil Change, L.L.C. is on the receiving end of a proposed class action that alleges the company violated federal law by sending text message advertisements to consumers’ cell phones without first obtaining their consent. The plaintiff claims he began receiving the defendant’s texts in November 2017 despite never agreeing to receive them. The texts allegedly contained links to coupons for the company’s services, and the man says he replied to each one with “Stop” in an attempt to avoid receiving more. Nevertheless, the suit claims, the defendant continued to send the messages, allegedly through the use of autodialing technology, and thereby intruded upon the plaintiff’s protected right to privacy.
