Martin et al v. Samsung Electronics America, Inc., et al
Filed: November 2, 2016 ◆§ 4:16-cv-06391
Another class action has been filed against Samsung alleging its exploding Galaxy Note7 smartphones 'pose a threat to the safety of consumers.'
Another class action has been filed against Samsung alleging its exploding Galaxy Note7 smartphones “pose a threat to the safety of consumers” – a threat that the company was aware of, yet actively tried to conceal. Filed in California, the complaint says Samsung failed to warn the public about the dangers presented by the lithium batteries in the devices and that the tech giant has yet to determine the cause of the problems.
According to the suit, all of Samsung’s popular smartphone models pose the risk of overheating, fire and explosion due to their design, development and manufacturing being similar to that of the Note7. Although Samsung has since recalled the Note7 smartphones and put a halt on sending out replacements after they, too, were found to pose a combustion risk, the suit claims the company attempted to “conceal the scope of the problem” through marketing campaigns and recall programs.
