Two plaintiffs claim Experian acted negligently in reporting an incorrect location for the courthouse in which they respectively filed for bankruptcy.
Experian Information Solutions, Inc. is staring down a proposed class action brought by two named plaintiffs who allege the company acted negligently and willfully in incorrectly reporting the location of the courthouse in which the individuals filed for bankruptcy.
Filed in California, the lawsuit states the plaintiffs respectively filed for bankruptcy in January 2016 and April 2017 in the United States Bankruptcy Court, Southern District of California, located at 325 West F Street in San Diego. According to the suit, the plaintiff’s Experian-produced credit reports noted the location of the court at “940 Front St RM 5N26 San Diego CA 92101” instead of its true address.
“As a consumer reporting agency, Experian had a duty and obligation to report true and accurate information regarding public records,” the lawsuit argues. “[The plaintiffs] believe that the inaccuracy was due to [the defendant’s] unreasonable procedures.”
