A proposed class action out of Florida federal court alleges eXp Realty, LLC placed unauthorized phone calls to a consumer in violation of the Telephone Consumer Protection Act (TCPA).
According to the case, a “key component” of eXp Realty’s marketing plan is purchasing sales leads and directing its agents to chase after these leads by placing autodialed calls to consumers without first obtaining their permission to do so. The plaintiff claims he received two such calls from the firm in July 2018 after removing his Orlando apartment listing from the market. The suit argues the defendant’s conduct was unlawful in that the man had no prior relationship with the firm or its agents and did not give the company his express written consent to receive the automated calls.
