A former University of Miami employee has filed a proposed class action against the school over alleged violations of the Employee Retirement Income Security Act of 1974.
A former University of Miami employee has filed a proposed class action against the school over alleged violations of the Employee Retirement Income Security Act of 1974 (ERISA). The named plaintiff claims the school violated its fiduciary duty to proposed class members by failing to make available all plan members’ retirement and welfare benefits to which they were entitled. Specially, the lawsuit contends that The U (as the University of Miami is colloquially known) allegedly failed to provide the proposed class with enrollment and retirement plan information even though it was made available to other employees.
“Indeed, not only did the University fail to disclose to the plaintiff and other members of the class that they were entitled to participate in the Plans, but it affirmatively communicated to the plaintiff … that they were not entitled to participate in the plans,” the lawsuit says, arguing that this nondisclosure amounts to an unlawful denial of employee benefits.
