Ex-Planet Fitness Member Sues Company Over Allegedly Unsolicited Promotional Text Message

Planet Fitness—Homestead is on the receiving end of a lawsuit that takes issue with an allegedly unlawful promotional text message sent to a former gym member.
Planet Fitness—Homestead is on the receiving end of a proposed class action alleging Telephone Consumer Protection Act (TCPA) violations stemming from a promotional text message supposedly sent to a former gym member.
After canceling his Planet Fitness membership at the defendant’s Homestead, Florida, location, the plaintiff received an automated text message from the company in August 2018 offering a discount should the plaintiff rejoin, the lawsuit alleges. The disputed text message stated, in part:
“[W]e’re making it easier than ever to come back to PF. For a limited time you can rejoin for $1 Down and get ONE MONTH FREE.”
The plaintiff claims he never provided his express written consent to receive automated telemarketing text messages from the defendant.
