ESA Management has been hit with a lawsuit on behalf of current and former employees who say they never received notice of their right to continue their health insurance.
ESA Management, LLC has been hit with a lawsuit on behalf of current and former employees who say they never received notice of their right to continue their health insurance under the Consolidated Omnibus Budget Reconciliation Act of 1985 (COBRA). The suit claims the defendant violated the Employment Retirement Income Security Act of 1974 (ERISA) – as amended by COBRA – by repeatedly failing to provide this notice in the event of a “qualify event,” which may include downsizing. The plaintiff is seeking statutory penalties, attorneys’ fees and costs, injunctive relief and other damages.
