From Texas federal court comes a proposed class action wherein the plaintiff claims Equinox Collection Services, Inc. mailed her a notice in which it attempted to add an extraneous, unauthorized processing fee for credit card and bank draft payments.
The plaintiff’s case revolves around a September 2017 collection notice in which the company allegedly indicated it charges a $5.00 fee for payment processing. Said fee is not authorized by the agreement that created the debt, the lawsuit argues, and constitutes an attempt from Equinox to collect an amount not owed by the plaintiff.
“[The defendant] misled and deceived [the plaintiff] into the belief that she falsely owed an additional $5.00 in addition to the debt,” the case reads, noting the imposition of the extra charge violates the Fair Debt Collection Practices Act (FDCPA).
