Equifax Faces Lawsuit over Alleged FCRA Violations

A lawsuit has been filed against Equifax Information Services LLC claiming the consumer reporting agency violated the Fair Credit Reporting Act.
A proposed class action lawsuit has been filed against Equifax Information Services LLC claiming the consumer reporting agency violated the Fair Credit Reporting Act (FCRA). According to the complaint, “Equifax's business practice is to not indicate a consumer's dispute unless the furnisher notifies Equifax of the consumer's dispute, even if Equifax has been directly notified of the dispute by the consumer.” The plaintiff says he received a copy of his consumer report from Equifax that contained false information about his mortgage. The plaintiff claims he then communicated his dispute of the allegedly false information to Equifax and Bank of America, the furnisher of the loan information. The complaint claims Equifax never received a copy of the consumer’s dispute directly from Bank of America, so it continued to report the disputed information without indicating in the report that a dispute had been made by the plaintiff. The case argues that this practice violates the FCRA and that Equifax “has a legal obligation to take reasonable procedures to assure maximum possible accuracy of the consumer report.”
