A California man filed a proposed class action against Equidata Inc., claiming the debt collector unlawfully used an automated dialing system to place calls to his phone.
A California man is the plaintiff in a proposed class action against Equidata, Inc., claiming the debt collector unlawfully used an automated dialing system to place calls to his cellular phone without prior consent. The plaintiff alleges he received at least 10 calls from the defendant regarding a debt he did not owe. Equidata supposedly left the same prerecorded message on his answering machine each time he was unable to answer the phone. According to the complaint, the plaintiff had “no business relationship with Defendant whatsoever and never provided Defendant with his cellular telephone number for any purpose.” The suit cites violations of the Telephone Consumer Protection Act and seeks injunctive and monetary relief for proposed class members.
