A proposed class action filed in New York claims defendant EOS CCA violated the Fair Debt Collection Practices Act (FDCPA). The complaint alleges the defendant, in a collection notice, unlawfully failed to clearly convey the amount of debt owed by the plaintiff. At issue in the case are allegations that the debt amount purportedly owed by the plaintiff may continually be accruing undisclosed interest and/or fees.
“The letter fails to disclose whether the ‘Total Amount Due’ may increase due to additional interest in the event payment is not made, the letter does not even provide by when payment had to be received in order for the plaintiff to satisfy her debt in full,” the complaint reads.
