EOS CCA, Inc. is on the receiving end of a proposed class action lawsuit that claims the debt collector sent a New York consumer a letter that failed to comply with the Fair Debt Collection Practices Act.
EOS CCA, Inc. is on the receiving end of a proposed class action lawsuit that claims the debt collector sent a New York consumer a letter that failed to comply with the Fair Debt Collection Practices Act (FDCPA). According to the suit, the letter set forth a “Principal” amount of $370.22 and “Fees Coll. Costs” of $161.56. The suit argues that the defendant failed to clearly explain the added “Fees Coll. Costs,” such as their source, whether additional charges will be applied, and how much the balance will increase. As a result, the complaint claims, the unsophisticated consumer is unlawfully deprived of the ability to calculate the true amount of his or her debt on a given day.
