Enhanced Recovery Company, LLC is the defendant in a proposed class action lawsuit that claims it violated the Fair Debt Collection Practices Act by failing to clearly communicate the true amount of a consumer’s alleged debt. The plaintiff says he received a letter from Enhanced Recovery that listed his “Original Balance” but neglected to specify whether that balance would increase due to interest or other fees. According to the complaint, the plaintiff’s account was, in fact, subject to additional fees that the defendant was required to disclose. By omitting this information, the suit argues that the debt collector hindered the plaintiff from being able to determine the true amount of his alleged debt.
