A consumer claims in a proposed class action that Enhanced Recovery Company sent her a collection notice that lacked certain mandatory disclosures.
Enhanced Recovery Company, LLC is the defendant in a proposed class action out of New York alleging some of its conduct violated the Fair Debt Collection Practices Act (FDCPA). The plaintiff claims Enhanced Recovery sent her a notice regarding a PayPal credit account balance underwritten by Comenity Capital Bank that failed to disclose whether the woman’s debt may increase due to accrued interest, late fees, or other charges. Although the plaintiff’s account was subject to accruing interest, Enhanced Recovery still had an obligation to disclose this in its communication, the case argues.
