Caudill et al v. Enhanced Recovery Company, Llc
Filed: August 24, 2018 ◆§ 2:18cv4821
Two New York consumers claim Enhanced Recovery Company sent them letters that failed to clearly identify the creditor to whom their debts are supposedly owed.
New York
Two New York consumers have filed a proposed class action in which they claim Enhanced Recovery Company, LLC sent them collection notices that failed to clearly identify the creditor to whom their debts are supposedly owed.
According to the complaint, the defendant did not adhere to the requirements of the Fair Debt Collection Practices Act in two letters it sent to the plaintiffs in February and May 2018. The plaintiffs claim Enhanced Recovery identified their creditor by stating “Creditor: Sprint.” The case argues that no entity named “Sprint” is registered with the state’s Division of Corporations, and that there are more than 100 registered entities whose names begin with “Sprint.”
“The least sophisticated consumer would likely be confused as to which of the one hundred (100) disparate entities registered in New York that begin their legal name with ‘Sprint’ is the creditor to whom the debt is owed,” the suit reads.
