A proposed class action suit filed in Wisconsin district court claims Enhanced Recovery Company, LLC violated the Fair Debt Collection Practices Act (FDCPA) when sending out certain collection letters to consumers. The lawsuit claims the collection letters sent by the defendant “impliedly threatened” the plaintiff by unlawfully stating that if the settlement offer was not paid immediately, her “delinquent account may be reported to the national credit bureaus.” This statement, the lawsuit argues, contradicts FDCPA-required language present in the letter saying the debtor has 30 days to dispute the debt and/or request verification of the original creditor’s contact information.
