A proposed class action alleges that Enhanced Recovery Company, LLC attempted to charge an illegal convenience fee on a consumer’s online payment.
According to the case, the plaintiff was directed by a November 2017 collection notice to visit the defendant’s website “for self-service options.” The site supposedly indicated that the man’s payment would be subject to a convenience fee of $8.95. The suit claims this fee was “neither expressly authorized by an agreement between the Defendant and/or the creditor, and the Plaintiff, nor permitted by law.”
