A proposed class action lawsuit filed against Enhanced Recovery Company, LLC, claims the group unlawfully failed to disclose in a collection letter sent to the plaintiff whether the debt owed would increase due to interest and/or fees. The complaint alleges this non-disclosure is a violation of the Fair Debt Collection Practices Act (FDCPA) because it could lead the least sophisticated consumer to be unsure of the exact amount of debt owed, as it may increase even if the full amount stated in the notice is paid in full.
