Defendant EEG, Inc, which does business as Empire Beauty Schools, is facing a proposed class action claiming it violated the Telephone Consumer Protection Act (TCPA).
Defendant EEG, Inc, which does business as Empire Beauty Schools, is facing a proposed class action claiming it violated the Telephone Consumer Protection Act (TCPA). The defendant, which runs 89 for-profit cosmetology schools across the country, allegedly placed telemarketing calls and sent text messages using autodialing software to consumers en masse. From the lawsuit:
“Unfortunately, Empire Beauty failed to obtain prior express written consent from consumers before sending them automated text messages or bombarding their cellular telephones with autodialed telemarketing calls. [The defendant] knowingly placed (and continues to place) these autodialed telemarketing and text message calls to cell phones without the prior express written consent of the call recipients.”
