A proposed class action recently removed to Florida federal court claims the approximately 137 homes located in Orange County, Florida’s Emerson Park subdivision have suffered damage due to negligence on the part of the homes’ developers and contractors. The case claims the plaintiffs’ homes have all suffered damage to the stucco covering their exteriors, noting that the uniformity of the damage across all the properties is evidence of the defendants’ negligence in designing and constructing the homes. According to the complaint, the “stucco deficiencies” include:
- “excessively cracked stucco”;
- “insufficient length of wire lath staples”;
- “poor embedment of lath into plaster”;
- “staples installed through window flashing”;
- “stucco paper backing not integrated with window flashing at sill”; and
- “improper stucco plaster installation.”
These alleged deficiencies, the lawsuit poses, have resulted in water damage and “unsightly” cracking and discoloration of the homes’ exteriors that the case claims the defendants are responsible for repairing.
