A proposed class action has been filed against Eltman Law, P.C. accusing the debt collector of failing to comply with the Fair Debt Collection Practices Act.
A proposed class action has been filed against Eltman Law, P.C. accusing the debt collector of failing to comply with the Fair Debt Collection Practices Act. The defendant, according to the complaint, sent a Texas woman a collection letter that falsely implied an attorney was meaningfully involved in the collection of the plaintiff’s debt. The letter’s law firm letterhead and attorney signature, coupled with language that the firm was “retained” by the plaintiff’s creditor, were meant to coerce the woman into paying off her debt as quickly as possible to avoid legal action, the suit says.
Furthermore, the case alleges the defendant falsely informed the plaintiff that the amount of her balance may change “because of interest that may vary from day to day” despite knowing her account was charged-off and would not accrue any additional fees.
