A proposed class action claims defendant Electrolux Home Care Products, Inc. violated California's Unfair Competition Law.
A proposed class action claims defendant Electrolux Home Care Products, Inc. violated California’s Unfair Competition Law by unlawfully charging shipping and handling fees that are “far in excess of the actual cost” of sending products to consumers. According to the 20-page complaint, the defendant’s shipping and handling charge is deceptive to consumers “who expect that shipping/handling charges are reasonably related to a company’s actual costs of shipping and delivery.” Further, the lawsuit argues the arbitration provision on the defendant’s website (Eureka.com) is unenforceable because, since no mutual consent was established with consumers, Electrolux can unilaterally change or modify the terms of the provision at any time and leave consumer to bear the full brunt of paying attorneys’ fees.
