A Pennsylvania woman has filed suit against Educational Computer System, Inc. over claims that the defendant debited her bank account without proper authorization.
A Pennsylvania woman has filed suit against Educational Computer System, Inc. over claims that the defendant debited her bank account without proper authorization. The plaintiff says she was pressured into providing the defendant’s representative with her debit card number for electronic auto payments but never signed written authorization for the payments. Citing alleged violations of the Electronic Funds Transfer Act (EFTA), the suit argues that Educational Computer System violated federal law by withdrawing monthly payments from the plaintiff’s account. Under the EFTA, “preauthorized electronic fund transfer from a consumer’s account may be authorized by the consumer only in writing, and a copy of such authorization shall be provided to the consumer when made,” the complaint reads.
