The case, which was recently removed from state to federal court in Washington, claims that Eddie Bauer regularly advertises both a certain percentage off “everything” and discounts off entire orders when, in reality, certain merchandise, such as third-party brand products, are excluded from the deals.
Further, the defendant allegedly inflates its original price points in order to create the illusion of good deals. The defendant “rarely if ever offers its products at the advertised list price,” the suit claims, pointing out that the company apparently advertises perpetual discounts most days of the year.
