A proposed class action out of federal court in Ohio alleges eClinicalWorks, LLC unlawfully sent junk fax advertisements that failed to contain a mandatory opt-out notice. The plaintiff, a Cincinnati law firm, claims eClinicalWorks did not obtain its permission before sending the faxes. The complaint claims more than 40 other parties have received unwanted faxes from the defendant.
