Eat Real Snacks USA LLC – maker of EatReal brand Quinoa Puffs, Quinoa Chips, Lentil Chips, and Hummus Chips – has been named in a proposed class action lawsuit.
Eat Real Snacks USA LLC – maker of EatReal brand Quinoa Puffs, Quinoa Chips, Lentil Chips, and Hummus Chips – has been named in a proposed class action lawsuit over allegations that the aforementioned products contain less of their “namesake ingredients” than their labels portray.
According to the suit, the products’ packaging represents that the snack foods are “derived exclusively from quinoa, lentils, and chickpeas” and advertise the benefits of eating foods made from these ingredients. The case argues, however, that the products actually consist mostly of corn, rice, and potatoes, noting that these ingredients appear as the second, third, and/or fourth items mentioned on the ingredients lists and are most likely present in greater amounts than quinoa, lentils, or chickpeas.
“No reasonable consumer would expect products represented as consisting of quinoa, lentil and chickpeas to be made from mostly rice, corn and potatoes,” the complaint argues, adding that the defendant’s representations were allegedly meant to mislead consumers into paying a premium price for products they believed were healthier than traditional snack foods. “Defendant’s intent was to distinguish its Products in the marketplace amongst the numerous other companies producing ‘better for you’ snack products.”
