Drunk Elephant’s Shaba Complex Eye Serum Fails to Deliver, Class Action Claims
Last Updated on May 8, 2018
Nguyen v. Drunk Elephant, Llc
Filed: February 6, 2018 ◆§ 7:18cv1051
According to a lawsuit, Drunk Elephant's eye serum cannot provide any of the skin improvement benefits the company promises.
Drunk Elephant, LLC faces a proposed class action lawsuit out of New York in which a consumer tackles the allegedly deceptive advertising, marketing and promotion of the company’s Shaba Complex Eye Serum. The plaintiff claims that despite the defendant’s claim that the serum “changes the structure and function” of a person’s skin, the product simply does not deliver any of its advertised benefits.
According to the complaint, Drunk Elephant claims the ingredients in its Complex Eye Serum can smooth skin roughness, improve radiance, decrease glycation and generally combat visible signs of aging. The plaintiff argues none of these claims are true, and that the public has been misled into spending a premium price—twice as much as comparable eye creams – for the product.
