Drug Free Workplaces USA faces a class action over a cyberattack that reportedly occurred in the spring of 2023 and compromised the personal information of approximately 37,000 individuals.

A settlement has been reached to resolve a proposed class action lawsuit that alleged Drug Free Workplaces failed to prevent a 2023 data breach that compromised consumers’ names and Social Security numbers.

The deal, which received preliminary approval from the court in October 2024, covers anyone who was sent notice of the data incident by Drug Free Workplaces.
To submit a Drug Free Workplaces claim form online, head to this page and enter the notice ID number found in the postcard settlement notice you received, along with your last name. You can also request a paper copy to return by mail by contacting the settlement administrator using the information here.
Class members must submit a valid claim form online or by mail by February 25, 2025 to get payments and other benefits from the class action settlement.

Class members who file a timely, valid claim form are eligible to receive up to $475 in reimbursement for documented, “ordinary” losses incurred as a result of the Drug Free Workplaces data breach. The settlement site says that ordinary losses may include, but are not limited to, bank fees, long-distance phone charges, postage, or fees for credit reports, credit monitoring or other identity theft insurance products.
Eligible consumers can also submit a claim for up to four hours of lost time spent dealing with the data beach, at a rate of $17 per hour.
Additionally, class members can submit a claim to get up to $5,000 for documented, unreimbursed losses caused by identity theft resulting from the data breach.
Covered consumers are also eligible to receive two years of free identity theft protection and credit monitoring services.
The court will determine whether to grant final approval to the terms of the Drug Free Workplaces settlement during a hearing scheduled for March 12, 2025. Settlement benefits will be issued to eligible class members only after the deal is approved and any appeals are resolved, the site says.
According to the initial class action lawsuit, the cyberattack occurred between March 29 and May 4, 2023, when an unauthorized individual gained access to two employee email accounts. The breach impacted personal information belonging to approximately 37,000 individuals on whom Drug Free Workplaces has conducted drug testing for employment purposes, the case claimed.
