Matzura v. Halstead Property, LLC et al
Filed: July 11, 2017 ◆§ 1:17-cv-05213
Douglas Elliman Realty and one other company are facing a class action claiming their website is not compliant with the Americans with Disabilities Act.
New York
Douglas Elliman Realty, LLC and Douglas Elliman, LLC are the latest companies to be hit with allegations that their website is not compliant with the Americans with Disabilities Act (ADA). The plaintiff, a blind New York man behind many recent ADA-website complaints, claims in the proposed class action that Elliman.com contains numerous accessibility barriers that prevent him from independently navigating the site and consuming important information therein. More specifically, the case alleges the plaintiff’s screen reading software, the same kind utilized by many blind internet users, cannot access, for instance, the locations of the defendants’ offices, hours of operation, or any information concerning real estate sales and rentals in various neighborhoods due to allegedly discriminatory accessibility roadblocks. The case further asserts the defendants’ website is “heavily integrated” with its physical locations to the point where Elliman.com falls under the ADA’s oversight.
