Two more gaming companies have been hit with a proposed class action over the alleged illegality of their online casino games under Washington state law.

To file a claim, head to this page and enter the unique ID number stated on the notice you received about the settlement by mail and/or email, then click “Continue” to proceed.
Valid claims must be submitted online or postmarked by April 11, 2023.
The settlement covers all consumers who played DoubleDown Casino, DoubleDown Fort Knox, DoubleDown Classic and/or Ellen’s Road to Riches while in the United States at any time on or before November 14, 2022.
DoubleDown players who file valid claims can opt to receive their share of the settlement via Zelle, PayPal, direct deposit or check. Importantly, settlement checks will expire and become void 90 days after they’re issued, the website says.
The amount a consumer might get from the settlement depends on how many people file claims and the total amount the claimant spent on in-game purchases while playing any of the DoubleDown Casino games listed above. Players who spent more in-game money will receive a higher percentage of their money back from the settlement, the website says.

The only way to receive payment from the settlement is by filing a claim. If you do nothing, you will get nothing from the settlement and give up your right to sue DoubleDown Interactive for the claims in the case.

As part of the settlement, DoubleDown has also agreed to make available to players information about “video game behavior disorders,” a voluntary self-exclusion policy, and changes to its game to allow continued play without the need to buy additional virtual chips, the website states.
The official website states that those who submit valid claims will receive payment from the deal within 90 days of the settlement receiving final approval from the court and the resolution of any appeals, which could take “at least 120 days after final approval.” A final approval hearing is scheduled for June 1, 2023.

In what’s quickly becoming the class action trend du jour, two more gaming companies have been hit with a lawsuit over the alleged illegality of their online casino games under Washington state law. The 18-page complaint, which mirrors similar proposed class actions filed this week, claims Double Down Interactive, LLC and International Game Technology’s Double Down Casino is not a free-to-play game as advertised, but rather an unlawful game of chance masquerading as an “innocuous” videogame. The lawsuit charges the defendants are responsible for injury to proposed class members in that the individuals would not have lost money wagering on the companies’ games of chance had Washington’s prohibition on online gambling been observed.
The lawsuit seeks from the court an order for the defendants to cease the operation of its gambling games and to recover all lost money, including interest, to proposed class members. The plaintiff claims he’s wagered and lost more than $1,000 playing the defendants’ games since 2016.
“As it stands, [the defendants] have retained millions of dollars in profits generated from their unlawful games of chance and should not be permitted to retain those ill-gotten profits,” the complaint argues.
