The 14-page lawsuit says that DoorDash has violated Oklahoma’s Telephone Solicitation Act—which aims to protect consumers from unwanted telemarketing calls or messages—by using an automated system to send unsolicited texts to the plaintiff and other individuals across the state.
According to the suit, the plaintiff has received promotional text messages from DoorDash since November 2022. For example, one text sent in February of this year encouraged the woman to “be [her] own boss” and “[finish] signing up as a Dasher” through a link provided in the message, the case relays.
To send the text messages at issue, the company purportedly used a system that automatically selected and dialed the plaintiff’s cell phone number, the complaint explains.
The woman claims she never provided written consent to authorize the communications, as required by state law.
The lawsuit looks to represent anyone with an Oklahoma area code who, since November 1, 2022, received a “telephonic sales call” (which includes text messages) made by or on behalf of DoorDash using the same type of equipment used to send the text message to the plaintiff.
