Nocera v. Dollar General Corporation et al
Filed: September 13, 2018 ◆§ 2:18cv1222
A lawsuit alleges several interior access barriers found in a New Castle, PA Dollar General make it unlawfully difficult for wheelchair-reliant shoppers to get around.
Pennsylvania
Dollar General Corporation and Dolgencorp LLC are the defendants in a lawsuit that alleges the companies’ New Castle, Pennsylvania store contains numerous “interior access barriers” that make it unlawfully difficult for the plaintiff to navigate up and down aisles in her wheelchair.
According to the Americans with Disabilities Act lawsuit, such access barriers found in the defendants’ store include:
- Fixed pillars in the middle of shopping aisles;
- Shopping and/or stocking carts positioned so that they block or narrow aisle pathways; and
- Merchandise displays placed so that they block paths of travel.
“The access barriers described above are not temporary and isolated,” the 12-page lawsuit claims. “They are systemic, recurring, and reflective of [the defendants’] inadequate policies and practices.”
