Pennzello v. Diversified Consultants Inc.
Filed: June 5, 2017 ◆§ 2:17-cv-03366
Diversified Consultants Inc. is the defendant in a proposed class action claiming that it failed to clearly communicate the amount of consumers' alleged debts.
Diversified Consultants Inc. is on the receiving end of a proposed class action lawsuit filed in New York federal court that claims the debt collector failed to clearly communicate the amount of consumers’ alleged debts in violation of the Fair Debt Collection Practices Act. The plaintiff says she received a letter from the defendant that listed “Total Non-Interest Charges or Fees Since Charge-Off” as “$16.37,” but neglected to indicate how the charges were calculated or whether they would increase. The suit argues that the defendant’s failure to clearly convey the amount of the plaintiff’s alleged debt hindered her from being able to determine how to make payments and settle her account.
