A new class action lawsuit out of New Jersey claims Diversified Consultants, Inc. violated the Fair Debt Collection Practices Act (FDCPA) in its communications with class members. The lawsuit alleges the defendant did not disclose in its collection letters, which were sent regarding alleged debts owed to Verizon Wireless, that the listed “current balance” included amounts for collection fees and/or interest. Specifically, the plaintiff claims the current balance noted in the defendant’s letters included an undisclosed 18 percent collection fee, a tactic the suit says is deceptive to the unsophisticated consumer under the FDCPA.
