The 18-page lawsuit says that the platform, which allows users to interact through instant messaging, chat rooms and voice and video calls, has violated California’s Automatic Renewal Law (ARL) by misrepresenting that it will stop charging monthly subscription payments when it cancels a consumer’s Discord Nitro subscription.
The suit further alleges that Discord, in violation of the ARL, has failed to plainly disclose the terms of its automatic renewal service and cancellation policy, and provide consumers with information about how to cancel. In addition, the platform has failed to give users an easy way to terminate their subscriptions online, the case claims.
According to the complaint, a consumer can enroll in a Discord Nitro Basic plan for $2.99 per month or a Discord Classic plan for $4.99 per month. Per the filing, a user may also choose to pay for a Discord Nitro plan at $9.99 per month, which offers additional features and perks to subscribers. Subscribers may also select a yearly membership, which is billed annually, the lawsuit shares.
As the suit tells it, the defendant may terminate a user’s account for various reasons, including if it discovers that a subscriber is under 13, the minimum age requirement to use the platform. The company represents that, in the event it cancels a membership, the subscription associated with the account will also be terminated, the case relays.
However, the complaint contends that Discord has failed to honor this promise and continued to charge monthly subscription fees after canceling a user’s account.
The plaintiff, a San Antonio resident, claims that her 10-year-old son’s Discord Nitro subscription was terminated by the platform in December 2020 because of the age requirement. Nevertheless, Discord continued to bill the woman for the canceled membership through February 2022, the filing alleges.
The plaintiff is apparently not alone in her experience with Discord, as other consumers have posted online complaints about its “deceptive cancellation policies and practices,” the case says.
The lawsuit looks to represent anyone in the United States who, during the applicable statute of limitations period, had their account canceled by Discord and were subsequently charged by the platform.
