A proposed class action filed against The DIRECTV Group, Inc. and Viasat, Inc. claims the companies sent unlawful text messages in a joint marketing effort.
Florida
A proposed class action has been filed against The DIRECTV Group, Inc. and Viasat, Inc. (doing business as Exede Internet) that claims the companies sent unlawful text messages in a joint marketing effort. According to the complaint, the defendants generated a standard 10-digit phone number to send text messages to the plaintiff and others en masse “while deceiving recipients into believing that the message was…[sent] by an individual.”
On February 9, 2018, the defendants allegedly sent an automated text message to the plaintiff advertising DIRECTV television services for Exede Internet customers. The unsolicited, automated text violated the Telephone Consumer Protection Act (TCPA), the case says, which prohibits the sending of automated texts without the recipient’s prior consent.
