A proposed class action alleging violations of the federal Telephone Consumer Protection Act (TCPA) has been filed in California against Direct Merchants Funding, LLC, which does business as Flash Advance. The plaintiff, whose number the complaint says has been in the National Do Not Call Registry since 2005, claims the defendant used a prohibited automatic dialing system to call consumers’ cell phones without prior consent. As described by the complaint, an employee of the defendant allegedly spoke with the plaintiff regarding purported prequalification for “working capital.”
