California
Friendlum, Inc. (which does business as Direct Home Energy Solutions) is on the receiving end of a proposed class action lawsuit alleging the company illegally placed auto-dialed calls to consumers’ cell phones without prior consent. The plaintiff, a California man, says he received a call from the defendant during which its representative asked him about his windows in an attempt to solicit his business. After the first call, the plaintiff allegedly received another call from a different representative and requested that she stop calling. According to the complaint, the plaintiff received three more calls in a row from the defendant.
Citing alleged violations of the Telephone Consumer Protection Act (TCPA), the suit argues that the plaintiff never provided the defendant his telephone number or his consent to receive the calls and did not have an “established business relationship” with the company.
