DialAmerica Faces Lawsuit Over 'Unlawful' Telemarketing Calls

A California woman filed a proposed class action against DialAmerica Marketing, Inc., alleging that it placed unlawful telemarketing calls to the plaintiff's cell phone.
A California woman filed a proposed class action against DialAmerica Marketing, Inc., alleging that the defendant placed unlawful telemarketing calls to the plaintiff’s cellular phone. The complaint claims the calls were made without prior consent and through an automated dialing system, and caused the plaintiff to become “frustrated and distressed” by the interruptions. Additionally, the plaintiff was charged for the calls by her cell phone carrier, according to the complaint. “Defendant’s calls forced Plaintiff and other similarly situated class members to live without the utility of their cellular phones by occupying their cellular telephone with one or more unwanted calls, causing a nuisance and lost time,” the suit says.
