A family-owned dentist's office in Florida has filed a lawsuit against Dentsply Sirona, Inc., claiming the medical supply company violated an amendment of the TCPA.
A family-owned dentist’s office in Florida has filed a lawsuit against Dentsply Sirona, Inc., claiming the medical supply company violated an amendment of the Telephone Consumer Protection Act of 1991 by sending unsolicited fax advertisements. The plaintiff claims it received a fax that contained information about the defendant’s products and did not include the required instructions that would allow the plaintiff to opt-out of future faxes. The fax was allegedly sent without the plaintiff’s consent. From the complaint:
“As a result of Dentsply's Fax, Plaintiff lost money or property in the form of the ink and paper used in printing the Fax, the additional wear and tear caused to Plaintiff's fax machine in receiving and printing the Fax, and the lost time and productivity of its employees in reviewing the Fax.”
