Debt Recovery Solutions, LLC is facing a proposed class action lawsuit that alleges violations of the Fair Debt Collection Practices Act.
Debt Recovery Solutions, LLC is facing a proposed class action lawsuit that alleges violations of the Fair Debt Collection Practices Act (FDCPA). According to the complaint, the plaintiff received a debt collection letter from the defendant that contained the following statements:
“You know a SALE works…they don’t last forever. Take advantage of this great deal NOW. Pay $100.58 by 12/24/2016 and this account will be SETTLED and CLOSED.
DON’T MISS THIS OPPORTUNITY
This SALE ends 12/24/2016.”
The suit argues that the letter is misleading because it intended to impart in the plaintiff “a false sense of urgency.” In reality, the complaint claims, the settlement offer is available “at any time” and threatening the plaintiff to make payments before a certain date is an alleged violation of the FDCPA.
